Terms of Service

These terms are the agreement between you and Ethan Nerone for your use of CreateThrough. By creating an account you accept them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

The service

CreateThrough connects to your social accounts to show you analytics about your own publishing, suggest content ideas, and publish posts you schedule. Features change over time; we may add, alter or retire them.

Your account

You are responsible for keeping your credentials secure and for everything done through your account. You must be at least 18 years old, and old enough to form a binding contract where you live. Provide accurate information and keep your email address current — it is how we reach you about security and billing.

Your content

Everything you create or connect remains yours. You grant us only the permission needed to run the service: to store your content, display it back to you, transmit it to platforms you choose to publish to, and process it to generate suggestions. We claim no ownership and will not publish anything you have not scheduled or requested.

You are responsible for what you publish through CreateThrough, including that it complies with the rules of the platform receiving it.

Connected platforms

LinkedIn, YouTube and Instagram are independent services governed by their own terms. Your use of them through CreateThrough remains subject to those terms, and we are not responsible for their availability, their API changes, or actions they take against your account. If a platform revokes our access or changes its API, some features may stop working, sometimes without notice to us.

Acceptable use

Do not use CreateThroughto publish unlawful, harassing or infringing content; to send spam or operate bulk automated posting across accounts you do not own; to circumvent a platform's rate limits or terms; to reverse engineer or disrupt the service; or to access another user's data. We may suspend or terminate accounts that do these things.

Plans and billing

Paid plans are billed in advance on a recurring basis through Stripe until cancelled. Cancelling stops future charges and takes effect at the end of the paid period; we do not prorate partial periods. We may change prices with at least 30 days' notice to existing subscribers. Fees are exclusive of taxes where applicable.

If a payment fails we will email you and may downgrade the account to the free plan after a short grace period.

Cancellation and deletion

You may cancel or delete your account at any time from Settings. Deletion is immediate and irreversible, as described in the Privacy Policy. We may suspend or terminate accounts that breach these terms, and will give notice where it is reasonable to do so.

Availability and disclaimers

CreateThroughis provided “as is”. We do not warrant that it will be uninterrupted or error-free, that scheduled posts will always publish successfully, or that analytics will be complete — much of that depends on third-party APIs outside our control. To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose, or one hundred US dollars if you paid nothing.

Changes to these terms

We may update these terms. If a change is material we will notify account holders by email before it takes effect. Continuing to use the service afterwards means you accept the updated terms.

Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of laws rules. Disputes will be brought in the courts located there.
